If you follow Brick Heroes, you have already seen the images of this Lex Luthor minifigure in early May thanks to the photos of bright87 (see this article). This minifigure is starting to be available everywhere, especially these days on eBay for around € 10 including postage.

Those who pre-ordered the US versions of the LEGO Batman 2 video game are also starting to receive their free minifigs with the game.

Le PS3 Collector's Pack (47.99 €) is also available for purchase at amazon.de, it includes this minifig of which Artifex has uploaded a nice little video review.
