LEGO announces today that it has obtained the status of "Well Known Trademark"in China, which should facilitate in the future the possibility of asserting its intellectual property rights before the various Chinese courts.
The legal outlines of this particular status are rather vague: It is attributed on a case-by-case basis to brands which request it and whose level of notoriety and reputation throughout Chinese territory are sufficient to justify obtaining it.
Let's not get carried away, this is above all about allowing LEGO to protect itself against fraudulent use of its logo and trademarks.
Obtaining this status is therefore just one more step in the long battle between LEGO and the various manufacturers who are taking advantage of the brand's notoriety to flood the Chinese market with counterfeit products. The manufacturer will have to continue to try to assert his rights in the Chinese courts but could possibly obtain higher damages in the event of a favorable decision or even prevent the registration of similar trademarks.
With the obtaining of this special status, LEGO thus joins other brands known worldwide as Disney, McDonald's, Motorola, Ferrari, L'Oréal, Gillette or Lancôme in the very closed club of brands which benefit from a level of protection. additional and additional remedies to defend their rights. Very few foreign brands in the Chinese market obtain this status.
